vzbv: Höchste Zeit für effiziente Sammelklagen in Deutschland und Europa

Europaweite Kampagne und Umfrage der Verbraucherorganisationen zum Weltverbrauchertag 2011

14.03.2011 - Effizientere Klagemöglichkeiten zur Durchsetzung von Verbraucherrechten fordert der Verbraucherzentrale Bundesverband (vzbv) anlässlich des Weltverbrauchertages am 15. März. "Recht haben und Recht bekommen sind nach wie vor zweierlei", fasst vzbv-Vorstand Gerd Billen den unzulänglichen Zustand zusammen. Angebot und Nachfrage könnten nur harmonieren, wenn unredliche Praktiken abgestraft und Verbrauchern entstandener Schaden zurückerstattet werde. Um dies zu gewährleisten, bedarf es effektiver Muster- und Sammelklagen, um Einzelinteressen zu bündeln.

"Das Recht auf Entschädigung" gehört zu den von den Vereinten Nationen verankerten Grundrechten der Verbraucher. Es ist das Motto der europäischen Verbraucherorganisationen anlässlich des Weltverbrauchertages am 15. März 2011. Anlass ist eine bis Ende April andauernde öffentliche Anhörung der Europäischen Kommission, die zu einer einheitlichen Position für den kollektiven Rechtsschutz in der Europäischen Union führen soll. Dabei geht es auch um die Notwendigkeit einer besseren Ausgestaltung von Sammelklagen. Anders als in Ländern wie Schweden, Portugal und Italien steht Deutschland einer Ausweitung der Klagebefugnisse bisher skeptisch gegenüber: "Die Einführung von Sammelklagen national und europaweit lehnen wir ab", heißt es etwa im aktuellen Koalitionsvertrag.

Zu einer anderen Einschätzung kommt der kürzlich von der Bundesanstalt für Landwirtschaft und Ernährung (BLE) veröffentlichte Evaluationsbericht über die kollektive Rechtsdurchsetzung in Deutschland. Der Bericht stützt die Forderung des vzbv nach Einführung von Muster- und Sammelklagen, mit denen Verbraucherverbände Ansprüche von Verbrauchern in einem einzigen Verfahren für eine Vielzahl von Verbrauchern klären lassen können. Die Studie kommt zu dem Ergebnis: "Um einen besseren Schutz der Verbraucher zu erreichen, sollten deshalb Musterklagen nicht auf den Bereich des Kapitalanlegerschutzes beschränkt werden und eine allgemeine Sammelklage, mit der Verbraucher gemeinsam ihre Schäden geltend machen können, eingeführt werden."

Abzocke darf sich nicht lohnen
Wer heute von Unternehmen abgezockt wird, erhält selten den entstandenen Schaden erstattet. "Das wäre anders, wenn effektive Klage-Instrumente die Rechtsdurchsetzung erleichtern würden", sagt Gerd Billen. Mit einer erweiterten Sammelklage könnten Rechtsfragen für eine Gruppe von Menschen einheitlich geklärt und Schadensersatzansprüche gebündelt werden. Billen: "Das stärkt die Position der Verbraucher und redlicher Anbieter, entlastet die Justiz, reduziert Kosten." Ziel sei keine Klageindustrie nach amerikanischem Modell, bei dem vor allem die Anwälte profitieren, sondern eine sinnvolle Ergänzung bereits bestehender und bewährter kollektiver Instrumente.
